Space conflict between the following two partitions

Hi,
I`ve got a Lenovo S12 Netbook with Windows XP and with originally 3 Partitions:
Boot Partition (Vol. C) , a second Data Partition (Vol. D) and a third hidden Recovery Partition.
After Linux (Ubuntu based Pear Linux 5) installation trial which ended in an error, I’ve got now a corrupted Partition table.
In additional to the original 3 partition there is a further 40GB Linux and a Linux swap partition. A Linux Boot Loader has not been installed.
Luckily Windows XP is still booting and also D: Volume is still present.
But I have now approx. 40 GB less disk space occupied by the Linux Partitions which I can’t use and those file system is likely corrupted too.
The Partition table is damaged now: Partition Magic (older version) did 2-3 changes, but could not help to fix. .
According to TestDisk there is a “Space conflict between two partitions”.
Current partition structure:

Could somebody please help me and advise if and how it’s possible to fix this Partition table issue.
